Trade-in Terms and Conditions
Who are we and what do we offer?
1.1 Welcome to Swappa Electronics, a Kenyan store for renewed and pre-loved consumer electronics operated by Swappa Electronics Ltd, a company registered in Kenya (referred to here as “Swappa Electronics”, “we”, “us” or “our”). Our Trade-in service lets you sell your used device to us for cash so we can inspect, refurbish and give it a second life.
1.2 Unlike a marketplace, Swappa Electronics buys your device directly. These Trade-in Terms and Conditions (“Trade-in Terms”) set out the rules that apply whenever you sell a device to us through the Trade-in service.
1.3 The Trade-in Terms sit alongside our general Terms of Service and our Privacy Policy. Where a topic is not covered here, those documents apply. If there is a conflict on a point that relates specifically to Trade-in, these Trade-in Terms take priority.
1.4 Trade-in is free to use. We do not charge you a fee to get an offer, and shipping your device to us is on us. The only cost that may apply to you is a return shipping fee in the limited situation described in Article 6.6.
Some definitions
Some words are used with a specific meaning throughout these Trade-in Terms, whether written in the singular or the plural:
| Seller | means any person who sells a device to Swappa Electronics through the Trade-in service. |
| Device | means the electronic product you offer to sell to us, such as a phone, tablet, laptop, gaming console or pair of headphones. |
| Offer | means the price we quote for your Device based on the information you give us. |
| Trade-in service | means the online tool on our website through which you can get an Offer and sell your Device to us. |
Who can use Trade-in to sell devices?
3.1 You may use Trade-in only if you are at least 18 years old and are selling a Device for personal, non-commercial reasons. If you are under 18, a parent or guardian must complete the sale on your behalf.
3.2 You agree to give us accurate details, including your full name, phone number and the M-Pesa or bank account where you would like to be paid. We may ask for a copy of your national ID or KRA PIN where our payment partner requires it for verification. We may hold your payment if the details you provide are incorrect, incomplete or do not match your identity.
3.3 You must not give false information or pretend to be someone else. You are responsible for everything done through your account, so keep your login details safe. We are not responsible for messages that fail to reach you because your contact details are wrong or out of date.
3.4 By starting a Trade-in, you confirm that you have read, understood and agree to be bound by these Trade-in Terms, and that you have the authority to enter into them.
3.5 We may update these Trade-in Terms from time to time. Changes take effect once they are posted here unless we say otherwise. The current version is shown to you before each sale, and you will be asked to accept it before the transaction can be completed. Because the terms can change between one sale and the next, please read them each time.
Which devices are eligible for Trade-in?
4.1 Trade-in currently covers mobile phones, tablets, laptops, gaming consoles and audio devices such as headphones and earbuds. We decide, at our discretion, which models are eligible at any given time. We may stop accepting a particular model without notice, but this will not affect any Offer we have already accepted.
4.2 We cannot buy devices that are blacklisted, reported lost or stolen, rooted or jailbroken, water-damaged or oxidised, bent, or counterfeit.
4.3 The condition of your Device directly affects your Offer. You will grade your Device during the Trade-in flow — from flawless to non-functional — and each grade has clear criteria explained in our Help Centre.
4.4 Where an accessory is needed for the Device to work as intended, please include it. Everyday accessories that we can easily replace — such as a standard charging cable or wall charger for a phone or tablet — do not need to be sent.
What information must you give us about your device?
5.1 When you use Trade-in you agree to describe the type and condition of your Device as accurately as possible, following the grading guidance in our Help Centre.
5.2 You will tell us (i) what the Device is, (ii) its brand, (iii) its model, (iv) its key specifications (for a phone, for example, whether it is unlocked or locked to a carrier), (v) its storage capacity, and (vi) its condition. You also confirm that: (a) you fully own the Device; (b) you did not obtain it illegally; (c) your description of its condition is honest and accurate; (d) you have not modified its software (for example, jailbroken or rooted it); and (e) you have removed all personal data and signed out of every account, or that you will do so before sending the Device to us. How do you trade in a device?
6.1 — Your first Offer
6.1.1 We generate a first Offer from the details you provide. The price is rounded to the nearest shilling and shown to you instantly so you can decide whether to continue.
6.1.2 This first Offer is based on what you told us. It is not final and does not create a binding sale until we have received your Device and confirmed that its condition matches your description. Accepting the first Offer does not, on its own, complete the sale.
6.2 — Sending your device once you accept the first Offer
If you accept the first Offer, you agree to:
- Provide your contact details — full name, phone number and physical address (county and town).
- Provide the M-Pesa number or bank account where you want to be paid, and upload a valid ID if our payment partner requests it.
- Erase all personal data and remove any lock codes, and sign out of iCloud, Find My, Google or any other account that could stop us from inspecting, repairing or reselling the Device. Instructions are in our Help Centre.
- Send the Device to us within twenty-one (21) days using the free prepaid shipping label, or hand it to the courier we arrange, packaged securely.
- Agree that ownership of the Device passes to us once we have paid you. From that point you give up any claim to the Device.
You are responsible for packing your Device safely for transit. We recommend taking clear photos of the Device before you seal the parcel; the confirmation message we send you includes packing guidance.
6.3 — Inspection and payment
6.3.1 When your Device arrives, we inspect it to check that it matches the description you gave under Article 5. If everything matches and you have met the requirements in Article 6.2, we pay the Offer amount to your M-Pesa or bank account, usually within two (2) business days. How quickly the money reaches you can depend on your provider.
6.4 — A possible second Offer
If the Device we receive does not match your description, the first Offer is void and the following applies:
- We have two (2) business days to send you a revised second Offer.
- You then have fourteen (14) days to accept or reject it.
- If you accept, the sale is firm and we pay the revised amount once your payment details are confirmed.
- If you reject it, there is no sale and we return your Device to you free of charge within two (2) business days.
6.5 — SMS updates
When you trade in a Device we send you transactional SMS updates that guide you through each step — how to ship it, how to sign out of your accounts, and when you have been paid. The number of messages depends on your order status, and standard message and data rates may apply. These messages are not required to complete the sale; you can opt out at any time by replying STOP. We will never sell or share your number with third parties for marketing. Your Device information and personal data are handled in line with our Privacy Policy.
6.6 — Ineligible or wrong devices
If the Device you send is not eligible under Article 4, or you send us the wrong item, we will let you know that we cannot buy it and the first Offer becomes void. If you want the Device back in that situation, you will need to cover the cost of a tracked return, and you must arrange it within five (5) days of us telling you.
What if you do not provide all the information we need, or stop responding?
7.1 If you do not give us the contact, payment and shipping details we need under Article 6.2, there is no sale and no Trade-in can take place.
7.2 If you send a Device but never wipe it or sign out of your accounts, we will remind you three (3) times over forty-five (45) days. If you still do not act after that period, we will not return the Device and we may recycle it responsibly, with no obligation to pay you.
7.3 If you have met the Article 6.2 requirements but do not respond to a second Offer, we will remind you three (3) times over fourteen (14) days. If you still do not respond, you will be treated as having accepted the second Offer, and we will pay you that amount.
7.4 If you have not given us valid payment details, or have not uploaded an ID our payment partner asks for, your payment will be held. If you still have not provided the details after sixty (60) days, and after at least one reminder from us, the sale may be cancelled.
What about returns?
Unless the return is at your expense (see Article 6.6), we return a Device to you by tracked shipment and share the tracking number with you. If a dispute arises after we say we have returned your Device and we cannot show proof that we sent it, we will pay you the amount of the first Offer.
What about liability for devices and services?
9.1 — The service. We work to keep the Trade-in service available, but we may suspend or limit it to carry out maintenance, repairs or improvements. We are not liable for any loss caused by the service being temporarily unavailable.
9.2 — Your device and your data. You are responsible for erasing all personal data and signing out of every account before sending us your Device. We are not responsible for (a) any loss caused by data you did not erase, or (b) any loss of data once the Device has left your hands. You release us from any claim relating to data stored on the Device or its security, confidentiality or disclosure.
We may cancel a Trade-in at our reasonable discretion if we suspect fraud. You may cancel your Trade-in at any time before you send the Device to us. No payment is due for a cancelled Trade-in.
How do we resolve disputes?
10.1 Working together. We would rather sort out any problem quickly and in good faith. If a difficulty comes up in applying these Trade-in Terms, both sides agree to try to find a fair solution together first.
10.2 Raise it with us first. Before starting any formal process, please send us a written notice describing the issue and what you would like us to do. You can reach our team through our contact page or by writing to Swappa Electronics Ltd, Nairobi, Kenya. We will try to resolve the matter informally within thirty (30) days.
10.3 Arbitration. If we cannot resolve the dispute informally, it will be referred to arbitration by a single arbitrator under the Arbitration Act of Kenya, seated in Nairobi and conducted in English. Either of us may still bring an individual claim before a small claims court where one is available.
10.4 Governing law. These Trade-in Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any matter not settled by arbitration.
10.5 Severability. If any part of this section is found to be invalid or unenforceable, that part is removed and the rest continues to apply in full.
